The mother of a woman who claims she was raped by two footballers told a court her daughter's personality changed after the alleged attack.

The Court of Session in Edinburgh is hearing the £500,000 damages claim by the woman against former Scotland international David Goodwillie and ex-St Johnstone player David Robertson.

Simon Di Rollo QC asked the 62-year-old how the alleged incident had affected her daughter.

She said: "She didn't really want to talk to people. She wanted to stay in the house. Before she was quite a bubbly person."

The mother said her daughter became withdrawn and was not "the happy young woman that she was" after the events in 2011.

"She never really went out and only ever really came down to see me and her dad," said the mother, who told the Court of Session in Edinburgh on Thursday that her husband had died the same year.

She said she had agreed to babysit her granddaughter to allow her daughter to go out for the evening on January 1, 2011.

The mother said: "We had already agreed she would come back at 1am."

She said her daughter did not return then, adding: "I tried to phone her mobile phone. It just went to the answer phone."

Mr Di Rollo asked if she became worried and she replied: "Yes, about 2am when I had not had any contact with her when she had said she would be home because her dad was ill."

She eventually made contact with her daughter at about 9am and her son went to collect her.

The mother said her daughter was upset and crying, and went straight to her room. She had arrived back wearing jeans but had not gone out in them.

She came back after changing her clothes and police were contacted.

Dorothy Bain QC, for Mr Goodwillie, pointed out that in an earlier statement to police the mother had said she phoned her daughter several times and it sounded like someone had hung up on three or four occasions.

The mother also agreed it looked as though she had sent a text message about 2am to her daughter asking her if she was OK.

A former schoolmate of the woman, who went out with her to pubs and a club in Bathgate, West Lothian, on the evening, said she had seen her at a bar in the Glenmavis Tavern, also known as Smiths, with David Robertson drinking, chatting and apparently flirting.

Mr Di Rollo asked: "Was he doing the same with her?" She replied: "Yes."

She explained that by flirting she meant they were leaning into one another and standing close to each other.

She added: "At one point I believe they kissed."

They later went to Chalmers nightclub and she said the woman "had had a drink, she was not completely compos mentis".

She said the woman got into a taxi with Mr Robertson and Mr Goodwillie and was asked if she said anything to Mr Robertson.

She said: "I don't remember the exact words but I think I would have said something along the lines of 'Look after her, make sure she gets home'."

The 30-year woman who is pursuing the action alleges both men raped her in the early hours of January 2, 2011, at a flat in Armadale, in West Lothian.

She maintains she was "visibly and obviously severely intoxicated" when she left and was offered a lift home in a taxi hailed by the footballers.

The woman says they asked the driver to drop all three of them at a flat in nearby Armadale, where she claims she was raped.

She contends she later woke up naked, alone and could not remember what had happened since being in the pub the previous evening.

The action states: "At the time when sexual intercourse took place with each defender, the pursuer was incapable because of the effect of alcohol of giving free agreement."

It is also claimed neither of the men had "a reasonable belief" she was consenting.

Mr Goodwillie accepts he had sex with the woman but maintains it was consensual. Mr Robertson also said he had sex with the woman but also maintains it was consensual. Both deny the woman was incapable.

The woman claims she has suffered symptoms of depression, panic disorder, anxiety and eating disorder since the alleged incident. She also claims she had to leave her job.

Mr Goodwillie, 27, who is now with Plymouth Argyle, and Mr Robertson, of Bathgate, both deny the allegations and maintain that intercourse was consensual. Neither was prosecuted.

They claim CCTV footage shows the woman was capable of walking, holding a conversation and using her mobile phone.

It is maintained it shows her openly flirting with and kissing Mr Robertson and walking with her arm linked through Mr Goodwillie's arm.

It is said voluntarily got in to the taxi with them. It is said she engaged in conversation and walked without difficulty from the taxi to the flat at Greig Crescent, Armadale.
