A drink-driver was caught four times the legal limit with a baby on her lap.

Marilyn Robertson, 35, of Murthly, Perthshire, was approached by police after stopping in traffic near the scene of a crash near her home in September last year.

She had an 11-month-old on her knee and another child elsewhere in the car.

The officer believed Robertson may have been a witness to the crash but arrested her after they found she was acting strangely and smelled of alcohol.

Fiscal depute Bill Kermode said: "She was travelling in a car with two young children when she was forced to come to an abrupt halt due to an incident where two cars had collided.

"The police attended because of the collision. An inspector spotted the accused and approached to ask if she had information about the collision.

"The inspector noticed she appeared irrational and was acting in a bizarre manner and that there was a strong smell of alcohol coming from her."

Robertson admitted driving on the B9099 at Murthly when she was almost four times the legal limit.

Solicitor Paul Ralph, defending, said: "I understand it was a serious road traffic accident and a number of police units were there.

"They were stopped for some time and that is how the child came to be removed from the car seat. She was reversing slowly with the child in her lap."

The sheriff noted Robertson had another conviction for a similar offence and banned her from the road for three years.

He also ordered her to carry out 135 hours' unpaid work and placed her under social work supervision for nine months.
