A woman has won a landmark civil case against a soldier who had been cleared of raping her in a criminal court.

The woman has been awarded £100,000 in damages following the case at Dundee Sheriff Court.

She sued Sean Diamond, who was based at Leuchars Station in The Queen's Dragoon Guards at the time of the alleged offence in a Dundee flat in July 2015.

The prosecution in the criminal trial alleged Diamond had begun the sexual assault while she was asleep, and then continued it after she woke up by holding her down.

Last year he was cleared by a not proven verdict after a four-day trial at the same court.

After the verdict, the civil case was raised, an action which the accused decided not to defend.

It is thought to be the first time in nearly a century in Scotland that a civil case has been won after an unsuccessful rape prosecution.

Rape support workers say this outcome will offer a ray of hope to those who are "denied justice" in the criminal courts.
