A man has died in custody a day after police used an incapacitant spray to arrest him.

Alan Hay, 50, was arrested by officers on Monday after they were called to a disturbance in Dalbeattie, Dumfries and Galloway.

An officer used PAVA spray, similar to CS gas, on Hay in order to bring the situation under control and take him into custody.

Hay appeared in court on Tuesday charged with vandalism, threatening and abusive behaviour and assaulting a police officer.

He pled not guilty and was transferred to prison after being remanded but fell ill later that day and was taken to hospital, where he died.

The Crown Office has now ordered watchdog the Police Investigations and Review Commissioner (PIRC) to begin an investigation.

A spokesman for the PIRC said: "The Crown Office and Procurator Fiscal Service (COPFS) has instructed the PIRC to undertake an investigation into police contact with Alan Hay, 50, who was arrested following a disturbance in Dalbeattie on August 1, during which an officer of Police Scotland discharged an incapacitant spray known as Captor PAVA.

"The investigation will focus on the discharge of PAVA, and the period while the man was in police custody before being transferred on August 2 into the custody of the Scottish Prison Service following his appearance at court

"The man fell ill later that day and was taken to hospital for treatment but died shortly after.

"A report on the commissioner's findings will be submitted to the COPFS in due course."
